Terms of Service

1. Agreement
These Terms and Conditions govern your access to and use of Supamail (the "Service") and form a legally binding agreement between you ("Customer", "you") and Supamail ("we", "us"). By registering an account, or by accessing or using the Service, you confirm that you have read, understood and agree to be bound by these terms.
If you are entering into these terms on behalf of an organisation, you represent that you have the authority to bind that organisation. If you do not agree, do not use the Service.
We may update these terms from time to time. Changes are posted on this page with the date of the last revision and become effective thirty (30) days after posting. Continued use of the Service after that period constitutes acceptance of the updated terms.
2. The Service
Subject to payment of any applicable subscription fees and your compliance with these terms, we grant you a worldwide, non-exclusive, non-transferable right to use the Service for your internal business operations during your subscription term, in accordance with your selected plan.
You are responsible for your users' compliance with these terms and for all activity that occurs under your account.
3. Subscriptions, trials and billing
New accounts include a 30-day free trial. No credit card is required to start a trial. At the end of the trial, continued use of the Service requires a paid subscription.
Subscriptions are billed per user, monthly or yearly, in US dollars. Yearly subscriptions are billed upfront at the discounted yearly rate. Unless you change or cancel your plan before the end of the term, subscriptions renew automatically for the same term and plan.
Fees are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period.
4. Your email accounts and data
You retain all rights to your email and other data. You grant us only the access needed to provide the Service — reading, organising, searching and drafting within your connected accounts.
AI-generated content (summaries, answers, reply drafts) is provided as assistance. You are responsible for reviewing anything you send. Drafts are never sent without your explicit action.
You are responsible for ensuring you have the right to connect any email account to the Service and to process the data it contains.
5. Acceptable use
You must not use the Service to send spam or unlawful content; to violate any applicable law or third-party rights; to attempt to access another customer's workspace or data; to reverse-engineer, resell or sublicense the Service; or to interfere with the Service's operation or security.
We may suspend or terminate accounts that breach these requirements, with notice where practicable.
6. Availability and changes
We work to keep the Service reliable and available, but we do not guarantee uninterrupted operation. We may add, change or remove features over time; where a change materially reduces the functionality of your paid plan, we will give reasonable notice.
7. Intellectual property
Supamail, its design, code and branding are our intellectual property. These terms do not transfer any ownership of the Service to you. Your data remains yours.
8. Limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and we exclude all implied warranties. Our aggregate liability arising from or related to the Service is limited to the fees you paid in the twelve (12) months preceding the claim. We are not liable for indirect, incidental or consequential losses, including lost profits or lost data.
Nothing in these terms limits rights you may have under consumer protection law that cannot lawfully be limited, including the New Zealand Consumer Guarantees Act 1993 and the Australian Consumer Law where they apply.
9. Termination
You may close your account at any time. We may terminate or suspend access for breach of these terms or non-payment. On termination, your right to use the Service ends and your data is handled as described in our Privacy Policy.
10. Governing law and contact
These terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction, except where mandatory local consumer law provides otherwise.
